SALES CONDITIONS
The present general sales conditions deal with the regulations relative to the products and services distance purchasing which are made available through internet, from the web site www.mgtartufo.com within the respect of the Italian regulation in matter of distance contracts (Legislative Decree 70/2003).
The seller of the products and the owner of the Website is M.G. S.r.l. with its registered office in Via Piano d’ischia 1, 66040– Gamberale (CH).

Before sending the order, the Customer is invited to read carefully the General Conditions that have been put at his disposal on the Website in order to consent him to reproduce and memorize them.
The contracts concluded with M.G. S.r.l. are ruled by the present General Conditions. Italian is the language at their disposal to conclude the contract.
The information, images, photographs, trademarks, products and in general the elements and material that the Customer finds on the Site are disclosed only for promotional and advertising as well as informational purposes; the Customer may download or copy the aforesaid information and material only for personal, non-commercial use.
CHOSING AND ORDERING THE PRODUCTS
The characteristics and the price of the various Products are mentioned in the page relative to each Product.
For the Products purchasing, the Customer will have to fill the order application form by electronic format, following the instructions contained in the Website. The Customer will have to add the Product to the “Shopping Cart” and then, after examining the General Conditions and the Privacy Policy, and also the expedition and invoicing data, by selecting the payment methods he wishes to adopt and then confirm the order itself.
Through the order confirmation, which has a value of contractual proposal, the Customer recognizes and declares to have acknowledged all the indications given to him during the purchasing procedure and to accept integrally the present General and Payment Conditions proposed.
The contract stipulated between M.G. S.r.l and the Customer must be intended concluded with the order acceptance from M.G. S.r.l. This acceptance will be communicated to the Customer through an email of confirmation of the order itself.
Once the order has been received, M.G. S.r.l. shall check the availability of the stocks for the fulfilment of the order. In the event that one or more of the Products are not available, M.G. S.r.l. shall timely send an email to the Customer who, within the next 24 hours, will have the right to reply in order to confirm the shipment of the Products available or cancel it. If the Customer will not reply within this time limit, the order shall be considered as confirmed and the available Products shall be shipped. In this latter case the full amount relating to missing Products shall be reversed or, depending on the chosen payment method, will not be charged to the Customer.
Any right of the Customer for a compensation for damages or indemnity is excluded, as well as any contractual or extra contractual responsibility for direct or indirect damages caused to persons and/or things, as a result of the failed acceptance or evasion, even partial, of an order.
PRICES
All sales prices of the products listed on the Site are expressed in euros (€) as the final price but do not include shipping costs that are always borne by the Customers and are shown separately in the order form. The Seller reserves the right to modify the prices at any time without prior notice, but undertakes to apply the prices indicated on the Site at the time the order is placed in the same way.
DELIVERIES
The products purchased on the Website will be delivered at the address indicated by the customer during the purchasing procedure.
The shipping charges are calculated on the basis of the Zone pertaining to the Country and to the total weight of the purchased products.
The M.G. S.r.l relies on couriers nationwide and international (DHL and UPS) that will ensure timely and safe transportation.
The customer can choose between two delivery options: standard and express. Obviously fresh Truffle must be shipped only by express courier.
Fresh truffles will be shipped in reinforced cardboard boxes, packed in special boxes of polystyrene for food containing tablets of synthetic ice, ready to ensure product freshness for 48/72 hours from the time of departure to any location in the world.
Express: It takes 24/72 hours to deliver the goods to destination. Delivery time depends on the destination country
Standard: From 2 to 5 days. Delivery time depends on the destination country.
However, without prejudice to cases of force majeure or unforeseeable circumstances, the ordered Products shall be delivered within a period of 7 (seven) working days from the day following the day in which M.G. S.r.l confirmed the order to the customer through an email.
The delivery times include working days only and do not include Saturday, Sunday and local or national holidays.
M.G. srl assumes no responsibility for delays due to couriers or customs.
Upon delivery of the Products by the Courier, the Customer must check:
- that the number of boxes is the same as indicated in the packing list (DDT);
- that the packaging is intact, not damaged or wet or otherwise tampered, including the seals.
Any damage to the packaging and/or to the Product or discrepancy in the number of boxes must be immediately stated in writing on the Courier’s delivery note. Once the Courier’s document has been signed without objection by the Customer, no further complaints may be made with regard to the outward appearance of the package delivered.
PAYMENTS METHODS
The Customer will be able to do the payment of the Products price and of the relative delivery expenses through PayPal circuit (credit card or PayPal account), or through bank transfer.
PayPal
Once the order is confirmed, the Customer will be again addressed to the PayPal site where he will be able to do the payment with his own current account, or else using a card, even a pre-paid one.
Bank transfer
Customer will have to process their bank transfer within 3 days after products order placement. Should this not take place, customer’s order will be cancelled. Customer who fail to wire a bank transfer may be contacted by M.G. S.r.l with the aim to find out whether the failure is to be ascribed to customer’s decision to refrain from purchase or other reasons.

Reason for payment: Customer will have to enter their order’s date and number, which can be retrieved in the order confirmation email.
RIGHT OF WITHDRAWAL
The Customer has the right to rescind the contract, without giving any reason, returning the Products purchased on the Site within 14 (fourteen) days from the date of the receipt of the Products.
To exercise the right of withdrawal, the Customer must send an e-mail to the following address: ordini@mgtartufo.com specifying the order data and the intention to exercise the right of withdrawal
An essential condition for being able to exercise the right of withdrawal is that the goods are returned undamaged, with original packaging, not tampered, accompanied by the receipt or invoice, attached to the expedition, and that the cost of all shipping charges are the responsibility of the customer. M.G. S.r.l reserves the right to refuse the return of those Products not complying with these requirements.
The right of withdrawal applies to a Product purchased in its entirety; therefore, if the Product is composed of multiple components or parts the cancellation may not be exercised only on a part of the purchased Product.
The Customer acknowledges that the right of withdrawal cannot be exercised for Products which are highly perishable on account of their consistency and which by nature are likely to deteriorate rapidly (art. 62 L. 27/12) and furthermore The right of withdrawal does not apply to the supply of goods made to specifications or clearly personalized.
In the case of exercising the right of withdrawal, M.G. S.r.l will reimburse the full price of the Products provided that they are returned by the customer within 14 days of exercising the right of withdrawal and however not before receiving the products from client.
Failure to insure the shipment for the invoiced value of returned products will, in the case of damage or loss during shipment, entitle M.G. S.r.l to claim for damage, by withholding the related amount from your payment.
Please note that the legislation provides that the right of withdrawal be exercised only by individuals (consumers) acting for purposes that are unrelated to his business.
The Right of withdrawal, then, can NOT be exercised by legal persons and natural persons acting for purposes related to a business. Excluded from the right of withdrawal also purchases made by retailers or by those who in any way purchase for resale to third parties.
In case a customer receives faulty products because of an internal damage caused during transport that was not found on reception or a mistaken delivery he/she has the right to return them and claim their replacement. Customer must send an e-mail to the following address: ordini@mgtartufo.com specifying the order data, motivation and wait to be contacted by M.G. S.r.l.
CANCELLING OR MODIFYING AN ORDER
If the Customer should wish to change or cancel an order already placed, he/she should send promptly, and in any case before receiving the shipping confirmation, an e-mail to ordini@mgtartufo.com. M.G. S.r.l. will do everything possible to satisfy the customer’s request. However once the product has been shipped the order cannot be cancelled or changed. The products shipped may however be returned through the procedure as above on the right of withdrawal.

S.r.l is reserving the right to correct such errors, the inaccuracies or the omissions even after an order has been sent, or to modify or update the information at any moment without prior communication.
